I attach at 11A a copy of a telegram setting out the decision made on similar points in regard to singapore. The decision does not exclude any post from the purview of the P.S. Commission apart from the posts that were already excluded under the terms of the Singapore Bill. Those posts were:-
(a) The Governor or an office of which the holder is a member of Executive Council or a member of the Governor's personal staff.
(b) The Chief Justice or a Judge of the
Supreme Court.
(c) The Chairman or any member or the P.J. Commission.
(d) Any office or rank in any naval, military or air force constituted or raised under any written law.
The Singapore ruling only provided that the authority of the . of j. as set out in Col. Regs. 23-26 inclusive, should be explicitly sureguarded.
2. Hong Kong proposes to exclude, under their Regulations, from the purview of the P.3. Commission the more important promotion posts. Class I Cadet mentioned in (c) is a promotion post on the scale £1,650 to £1,300 busic. The Bill itself (below 6 of '48 file) provides that the Commission shall advise on the filling of such vacancies and on such promotions, etc., as may be prescribed. Apart from Singapore we have not received proposals from other Governments that the P.s. Commission should deal with appointments and promotions which come within the authority of the J. of 3.
3. I consider that the Hong Kong proposal to exclude certain senior posts from the Purview of the Commission is preferable to the arrangement that was accepted in regard to singapore. I see no objection to the Commission advising on the super- scale posts referred to in the last part of paragraph 2 of 11, provided the authority of the s. of s. is safeguarded. In view of the singapore decision, objection could not be raised to the Commission advising on all posts, subject to the prescribed exceptions, if the Governor considered this desirable.
